Goods & Service Tax (GST) is an indirect tax which is levied on every supply of goods or services, unless it is specifically exempted / excluded from its scope. In simpler term, GST is payable on every sale / purchase of good as well as provision of service in India, unless otherwise exempted.

Certain persons are required to obtain GST Registration compulsorily. Such as businesses having inter-state supply or intra-state annual turnover of more than Rs.40 lakhs in case of supply of goods (Rs.20 lakhs in case of provision of services), ecommerce operator, etc. Any person who is not required to register under GST compulsorily can also obtain voluntary GST registration and file GST returns. This is especially useful for those who purchase goods which are liable to GST and want to take input credit.

Once a person is registered under GST, it is compulsory for him to file Monthly / Quarterly returns. This means that even if business has not started or there is no GST liability or GST Credit, still a person registered under GST has to file his returns. In such case, he may have to file Nil Return. But it is compulsory to file such Nil return. If return for any one Month / Quarter is not filed, then it you will not be able to file the next Month / Quarter’s return also.

Note:

  1. Once you have taken GST number (GSTIN), it is compulsory to collect the GST.
  2. After taking GST number (GSTIN), you cannot claim the basic exemption (i.e. Rs.40 lakhs for goods, Rs.20 lakhs for services, etc.).
  3. Once you have taken GST number (GSTIN) it is mandatory to file the GST Return although you may have not started the business.
  4. Nil return is also compulsory to file, in case of no reportable transactions.

Benefits of filing GST Return timely

Apart from the fact that it is a legal requirement in most cases, the following are some of the benefits of filing GST return in time

Seamless Input Credit

Timely filing of GST return allows the taxpayer as well as his customers to claim input credit on GST paid on purchases which can be used to set off GST liability on sales

Strong Business Image

Your buyers / clients know whether you file your GST return timely or not, based on the time when Input Credit on goods purchased from you is reflected in their GST account. Thus, timely return filing helps to maintain strong business image

Avoid Late Filing Fees

In case, GST return is filed late, then Late filing fees of Rs.100 or Rs.200 per day is payable. The maximum late fee amount can be Rs.5000

Avoid Penal Interest

If GST is not paid within the due dates, interest @ 18% p.a. is payable for delaying in GST payment

Consequences of not filing GST Return

Cancellation of GST Registration

If GST return is not filed for six months or more, your registration is cancelled by the GST department

Subsequent return not allowed to file

Non-filing of GST return for any previous period, does not allow the taxpayer to file return for any subsequent period also. This continues until earlier return is filed and GST is paid, along with late filing fees and interest.

Penalty

If you do not file GST return and thus do not clear GST liability, penalty of Rs.10,000 or to the extent of GST amount evaded can be levied. This will be over and above interest charged

E-way bill generation blocked

GST taxpayers having turnover of more than Rs.5 crores will not be allowed to generate e-way bill, if they have not filed returns for two or more months

Input Credit Unavailable

If you don’t file your GST returns, your buyers/ customers will not be able to avail GST Input Credit. This can affect your business relations or dealing with them

Prosecution

Prosecution can be initiated against a person who has not filed GST returns and, thus, has not paid GST collected from buyers/ customers. If convicted, jail term can be 1-5 years
